Acceptance of Terms and Conditions
By placing an advertisement with Kidsguide, you
(‘the Advertiser’)
are accepting
Kidsguide's Advertising Terms and Conditions and Kidsguide's
Disclaimer and Conditions of Use.
Editorial approval
Please note that the content
and position
of all advertisements and listings is subject to Kidsguide’s editorial
approval. Kidsguide reserves the right to refuse any application for
listings or advertisements without explanation.
In this event, if payment has already been made this will be
refunded as soon as practicable.
Payment
All featured listings and logoboxes
on inner pages are subject to a
six month minimum period.
All others
are subject to a
one month minimum
period.
Payment
covers a period starting from the first day the advertisement goes on-line.
No VAT is applicable.
Invoices are issued by email but hard copies can be posted on request. The
first payment must be received by Kidsguide in advance of any advertisement being put on-line.
If future payments are not
made on time, the advertisement may be removed without further notice.
Quick and easy online payments
The easiest and quickest way to pay is on-line using PayPal's secure payment
system (as used by eBay). You can chose to pay by credit
card, debit card or bank transfer. As payment is received by Kidsguide immediately,
your advertisement will go on-line without delay. To pay via PayPal either
book your advertisement on-line and follow the instructions or email
Kidsguide and ask for a PayPal payment request.
Off-line payments
Off-line payments can be made by standing
order, by cheque or bank transfer.
Monthly payments
Advertisers who wish to spread the cost may choose to pay monthly. Monthly
payments must be made by standing order.
Advertising rates
Advertising rates are clearly posted on Kidsguide's
advertising pages or on
application by email.
All prices are in pounds sterling. Kidsguide reserves the right to amend advertising rates at any time.
Advertising
rates will be honoured for a period of 21 days from submission of
an
advertising
order form. If payment has not been made within 21 days
from submission of the
order form and
rates have
changed within the intervening time, the advertisement will be subject to
the new rates. In these circumstances the Advertiser will be informed of the
rate change and will have the right to cancel.
Cancellation and refunds
If you wish to cancel your advertisement, simply
contact us giving one month's
notice.
Refunds will be made
pro rata for any remaining unused whole months. Refunds will be made
within 30 days of Kidsguide receiving notification of
cancellation. Cancellations cannot be made during the initial
six months minimum period for
featured listings, sponsorship logos and banners.
Cancellation by Kidsguide
Kidsguide is a family-friendly site. If at any time an Advertiser or
advertisement is no
longer considered appropriate to be listed on Kidsguide, the advertisement
will be removed.
Kidsguide reserves the right to remove any listings or
advertisements without notice or explanation.
In the case of paid advertisements, Kidsguide will inform the Advertiser in
question as soon as practicable and will refund payment pro rata for any
remaining unused whole months.
Advertising positions
Advertising
positions on any pages of
Kidsguide are allocated on a first come first served basis and at the sole
discretion of Kidsguide. Kidsguide will try but cannot guarantee to offer an
Advertiser's preferred position within the website. In particular, Kidsguide
reserves the right to editorial approval in determining the most appropriate
location for an advertisement. Featured listings will only be placed in a
directly relevant category. In the case of free listings (including those
guaranteed as part of a paid advertising package) Kidsguide has complete and
sole discretion over the location of the listing. Free basic listings are
organised by topic and listed strictly alphabetically (or chronologically
for events). If payment is not made on time,
Kidsguide reserves the right to remove the advertisement
without further notice to the Advertiser and the slot may be offered to
another advertiser.
Timings
In most cases, advertisements will appear on the live web site within ten working days of receipt of payment and
materials. In many cases this may be
even sooner. However, there are occasionally delays and Kidsguide
accept no liability
for any loss of business or difficulties arising from
any delay. If timing is very important (e.g. imminent event or product
launch) please contact Kidsguide well in advance.
In such circumstances
Kidsguide will make every effort to ensure your timescale is met. However,
we cannot guarantee this. Once or twice a year Kidsguide
website is "frozen" for a limited period. During this time the web site remains on-line as usual
but no additions or changes are made to the site.
Accuracy
Every effort
is made to ensure the accuracy of material including advertisements within
the Kidsguide website.
However,
Kidsguide accept no liability for any loss or damage howsoever caused as a
result of any errors or omissions.
As soon as
the advertisement goes on-line you will be notified via email.
Advertisers
must check their advertisement immediately and inform Kidsguide of any
errors to be amended.
All
amendments will be made as quickly as possible by Kidsguide and usually
within 1 working day of notification.
If the error is Kidsguide's fault, your advertisement period will not start until
the error is corrected.
Changes and amendments
Advertisers may request up to two changes free of charge to the content of
their advertisement in any six month period.
Additional changes will incur a small charge of £10 per change.
Advertisers are
therefore reminded to ensure that their advertisements are drafted in such a
way as to not require regular changes. Amendments necessary due to
errors made by Kidsguide will be made as soon as possible at no charge to
the Advertiser.
Intellectual
property rights
By supplying any materials including logos, trade names, copy, images, etc. to
Kidsguide, you are guaranteeing that you have all licenses, rights and approvals to
use these materials
and that you
for the full amount of
any claims and reasonable legal fees incurred in connection with such claims
brought by any third party for breach of intellectual property rights.
Trading standards
By placing an advertisement with Kidsguide, the Advertiser
warrants that the advertisement is decent, honest and truthful and complies
with any relevant codes of practice and current legislation. The advertiser
agrees to indemnify Kidsguide in respect of any loss, costs, damages, or
other charges incurred as a result of legal actions or threatened legal
actions arising from the publication of the advertisement.
Logos
Logos should be supplied as a .jpeg or .gif file. They should be no larger
than 90 pixels wide by 70 pixels deep. Images should emailed to
advertise@kidsguide.co.uk
Banners
Banners should be supplied as a .jpeg or .gif file. They should be 546
pixels wide by 70 pixels deep (or smaller). Images should emailed to
advertise@kidsguide.co.uk
Downtime
Kidsguide.co.uk is
an AS IS service and cannot accept any responsibility
whatsoever
for problems arising from
temporary or permanent unavailability of the site.
Kidsguide
will make every effort to ensure the smooth and efficient running of the
website.
However, as with all technology, it is possible that there may be failures
from time to time which are beyond Kidsguide’s control.
Where it
is shown that the downtime has lasted for a period of 7 days or more, and it
is shown that this is the fault of Kidsguide,
your advertisement time will be extended
free for charge for the time the advertisement was offline. For example if
Kidsguide were offline for 10 days, you would receive 10 days free
advertising at the end of the existing advertisement contract. In the even less likely
event of Kidsguide being offline permanently, advertisers would be
entitled to a refund of paid advertising fees pro rata (e.g. if Kidsguide
went permanently offline three months into a six month contract, you would
receive a refund of 50%).
Kidsguide accepts no
liability for any loss or damage including without limitation, indirect or
consequential loss or damage, or any loss or damage whatsoever arising from
loss of data or profits arising out of or in connection with any downtime.
Notices
All notices made by Kidsguide will be sent to the
email address provided by the Advertiser on the order form. Kidsguide must
be notified immediately of any changes in Advertiser's contact details at
the address below. All notices sent by the Advertiser must be sent to the
below address.
